Facade advertising – what construction law allows and what to avoid

10 czerwca 2025

Advertising on a building façade is one of the most frequently used forms of promotion in urban space. It is visible, eye-catching and relatively durable, but before you decide to install it, it is worth getting to know the applicable regulations. Outdoor advertising in light of the construction law is a topic that raises many questions — about permits, location and limits arising from local regulations. In this article we answer the most important ones and suggest how to organise advertising legally and safely.

What in fact is advertising on a building façade?

Advertising covers all forms of visual message — banners, light boxes, 3D letters or boards — placed on the façade of a building. Advertising on a building façade can be permanent or temporary, illuminated or not, mounted directly on the wall or by means of support structures. In every case you need to take care not only of the aesthetics but, above all, of compliance with applicable law.

Outdoor advertising and construction law — key rules

The placement of advertising is regulated by the Construction Law and by the so-called Landscape Act. The main principle: if the advertising has a permanent connection with the ground or building (e.g. through structure, power cables, anchors), it may require a building permit. For temporary advertising, a notification is often enough.

Local landscape resolutions deserve particular attention — they specify what permitted advertising on buildings is accepted in a given municipality. For example: they may prohibit advertising above a certain height, limit formats, colours or the number of elements.

Where can outdoor advertising be placed?

It depends on the status of the property, the provisions of the local zoning plan and local regulations. Where can outdoor advertising be placed legally?

  • On the walls of private buildings, after obtaining the owner’s consent and in line with the zoning plan.
  • On property fences, as long as they do not extend beyond the plot.
  • In the road right-of-way — only after obtaining the consent of the road administrator.
  • On commercial sites, provided they do not breach occupational safety and fire regulations.

For monuments, multi-family buildings or housing communities the consent of the conservator or the community may additionally be required.

Permitted advertising on buildings — how to recognise it?

Not every advertisement will be legal just because it has been “hanging” for years. Permitted advertising on buildings must meet several conditions: it cannot threaten the structure of the building, obscure windows or architectural elements, and its installation cannot interfere with fire safety installations. Aesthetics also matters — landscape resolutions often prohibit garish colours, flashing lights or large surfaces on listed properties.

Advertising and a building permit — when is it needed?

Many people are not aware that advertising and a building permit are linked issues. If the advertising is permanently connected to the building or relies on its own structure, it may require a permit. This applies, among others, to illuminated light boxes, pylons, billboards and large 3D letters. The lack of a permit may result not only in an administrative fine, but also in an order to remove the advertising.

Advertising on a building façade — regulations in practice

Advertising on a building façade — in this case the regulations clearly define what is allowed and what to avoid. This concerns not only dimensions and structure, but also the placement in relation to load-bearing elements and safety systems. It is not allowed to obscure hydrants, smoke detectors, evacuation routes or ventilation devices. In the event of non-compliance with these rules the owner of the property may bear civil or administrative liability.

Summary — act legally and consciously

Outdoor advertising and construction law is a topic not worth disregarding. Proper preparation, knowledge of the regulations and cooperation with an experienced contractor is the key to success. If you are planning advertising on a building façade, make sure it is not only eye-catching but also compliant with the law.
